A dispute over a proposed subdivision near Cortaro Farms Road and Interstate 10 is scheduled for its day in court on July 21.

The DeAnza Specific Plan, a 311-house development, was challenged when a referendum was filed in December, putting the issue of rezoning the subdivision before voters sometime early next year.

Attorneys from Fidelity National Title, representing the developers, maintain the referendum was filed after the usual 20-day deadline, despite town officials saying it was OK.

Marana officials argued that the April 25 lawsuit should be dismissed because it needed to include all the landowners, not just the developers. The plaintiff said the issue at hand regarded Marana and Marana alone.

Opening arguments will be held in Pima County Superior Court on July 21 at 1:30 p.m. in Judge John E. Davis’ courtroom.
