An Amphitheater High School teacher accused of sexual misconduct with a student has been charged with a Class Two felony.

David Rogers, who has taught at the high school for 14 years, has officially been indicted by the Pima County Attorney's office with one count of sexual misconduct with a minor.

Stephanie Coronado, of the Pima County Attorney's office, said Rogers' first court date is set for Feb. 17 at 9 a.m. in Pima County Superior Court.

The Amphitheater School District placed Rogers on paid administrative leave after the allegations surfaced in October when school Principal Jon Lansa was shown Facebook messages between Rogers and the 16-year-old female student, who were allegedly discussing the current condition of her vehicle so she could go to Rogers' house.

Lansa immediately called Tucson Police regarding the matter.

According to court documents, the female student originally denied anything had happened, but later told police she and Rogers allegedly had sex.

A counselor at Amphitheater High School has also been placed on paid administrative leave for not reporting the alleged misconduct.

The counselor was allegedly given a letter by the student that told her what had happened.

However, the counselor was also said to be having a relationship with Rogers.

Coronado said the counselor has not been charged with a crime, and "the attorney's office is still figuring out how to proceed on the matter."

According to federal law, it is a crime not to report sexual misconduct between a teacher and a student.

The Explorer always withholds names of victims, and has withheld the counselor's name since no criminal charges have been filed at this time.
