Oro Valley councilman Brendan Burns has been indicted on counts of first-degree burglary, a class two felony, and disorderly conduct/domestic violence, a class six felony.

Court records show that both charges came following a May 20 incident in which Burns was alleged to have burglarized the residence of his wife while in possession of a knife.

Burns, who is serving his first term on council, is currently free under conditions that he does not make unconsented contact with his wife.

While Burns declined to comment, his attorney Joel Feinman said, “He is innocent until proven guilty, and he will be vindicated eventually.”

The indictment comes following charges of four misdemeanors against Burns for violating a court-ordered restraining order in March.

Burns is next scheduled to appear in court on Aug. 11. Judge Javier Chon-Lopez has been assigned to the case.

If convicted, Burns could face prison time.

For his own, his family's, and Oro Valley's sake, he should just resign before the election.
